Our Commitment

Aux Sable Liquid Products Inc. and its affiliates and subsidiaries (collectively, “Aux Sable”) is committed to safeguarding the personal information of individuals with whom Aux Sable interacts, such as employees and individual contractors.  The policy also applies to any person providing services on our behalf.  Aux Sable manages your personal information in accordance with applicable laws.

Personal information defined

Personal information refers to any information concerning an identifiable individual.  Some examples of personal information are: an individual’s home address and phone number, age, gender, marital or family status, an identifying number, financial information, educational history, etc.

Limiting Collection

Aux Sable limits the amount and type of personal information collected to that which is necessary for the identified purpose.  Aux Sable may collect (as an example) personal information such as name, address and contact information in order to provide you with important information about pipeline and plant safety and to respond to your questions or concerns.

Consent, Use and Disclosure

Aux Sable uses reasonable efforts to ensure that individuals understand how their personal information will be used and identifies the purpose(s) for which personal information is collected before or at the time the information is collected.  Aux Sable obtains consent (verbally, electronically, or in writing) as required for the collection, use and disclosure of personal information.  

When determining the appropriate form of consent, Aux Sable considers the sensitivity of the personal information and the reasonable expectation of the subject individual.  For example, Aux Sable will obtain express consent (i.e. electronically, or in writing) when the information is considered to be sensitive; implied consent may be appropriate when information is less sensitive (e.g. the individual’s name or contact information, if it does not reveal any additional information about the individual).

Aux Sable generally seeks to obtain consent at the same time personal information is collected.  Aux Sable may, however, seek consent to use and disclose personal information after it has been collected, but before it is used or disclosed for a new purpose. 

If Aux Sable identifies a new purpose for the personal information that it has collected from you, Aux Sable will obtain your consent before using your personal information for the new purpose. 

Consent may be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice.  Aux Sable will respect the decision and inform the individual of the implications for withdrawing consent.  The withdrawal of consent may change the ways in which Aux Sable may interact with you.  

In certain circumstances, Aux Sable may collect and/or use personal information without the knowledge or consent of the subject individual.  For example: 

  • It is clearly in the interests of the individual and consent cannot be obtained in a timely way (e.g. when the individual is seriously ill or mentally incapacitated)
  • Obtaining prior consent would defeat the purpose of collecting the information (e.g. in the investigation of a breach of an agreement or a contravention of a federal or provincial law)
  • In the case of an emergency where the life, health or security of the individual is threatened
  • To a company or individual employed by Aux Sable to perform functions on its behalf (e.g. outsourced payroll function, administration of health services plan)
  • To comply with a subpoena, warrant, or court order

Safeguards

Aux Sable endeavors to restrict access to personal information to those persons that have a legitimate requirement to access that information.

Aux Sable makes reasonable efforts to protect personal information against risks such as loss or theft, unauthorized access, disclosure, copying, use, modification or destruction, regardless of the format in which it is held.  Care shall be taken in the storage of personal information to prevent unauthorized parties from obtaining access to the information.  While Aux Sable uses reasonable efforts to safeguard the confidentiality of your information, we cannot guarantee that electronic commerce is totally secure due to transmission errors, outside events, third party hacking or other causes.  

Aux Sable retains personal information only as long as is reasonable to fulfil the purposes for which the information was collected or for legal or business purposes.  Personal information that is no longer required to fulfill the identified purposes or required by law to be retained is destroyed by confidential means (e.g. shredding, erasure, made anonymous).

Accessing your Personal Information

Upon request, Aux Sable provides individuals with access to their personal information held by Aux Sable.  Further, individuals have the right to challenge the accuracy and completeness of their personal information held by Aux Sable, and to have it amended as appropriate. 

Aux Sable responds to requests for access to, or the updating and correction of, personal information within forty-five (45) business days of receipt of the request, unless an extension is granted. Response time is consistent with applicable legislation and could be sooner than 45 days if and when possible.  Access is given by allowing the individual to view Aux Sable’s documentation, or by providing them with a reproduced copy of the information.  Please note that Aux Sable’s original documents are not to leave the premises. Aux Sable has the right to charge an individual a reasonable amount to recover the cost of producing and delivering documents requested by an individual.  Requests for access may be made verbally or in written form.  

Aux Sable will refuse to provide access to personal information if:

  • It would reveal personal information about a third party
  • The disclosure would reveal confidential business information
  • The information is protected by solicitor-client privilege

If access to information is refused, Aux Sable shall, in writing, inform the individual of the refusal, the reason(s) for the refusal, and any recourse the individual may have to challenge Aux Sable’s decision.

Consent to Transfer

This Website is operated in the United States.  If you are located in the European Union, Canada or elsewhere outside of the United States, please be aware that any information you provide to Aux Sable will be transferred and stored in to the United States. By using this Website or providing us with your information you consent to this transfer.

Aux Sable Website

A visitor to the Aux Sable website, www.auxsable.com, is not required to reveal any personal information, such as name, address, or telephone number. Nor is such information collected passively by electronic means.

Personal information is only collected when a visitor voluntarily complete a request form or survey. Personal information collected during the online application is only used to respond to your inquires or requests and is not used for any other purposes. We will not send you any unsolicited electronic communication.

In some cases, our website may collect visitor information that is not personally-identifiable. Examples of this type of information includes: Internet protocol (IP) address, type of Internet browser and domain name. This information is used internally, only in aggregate form, to better serve you by helping us manage and improve the content of our website and to diagnose technical problems.
